NASCAR Lawsuit: 23XI Racing and Front Row Motorsports Face Charter Loss

According to the Fourth Circuit Court of Appeals in Richmond, Virginia, 23XI Racing and Front Row Motorsports are on the verge of losing their NASCAR charters — status that guarantees a spot in every race.

In early May, a three-judge panel consisting of Paul Victor Niemeyer, Steven Agee, and Stephanie Thacker heard arguments from both sides. A month later, they revoked the injunction protecting the teams’ charters.

“You can’t have your cake and eat it too,” stated the court to the team’s attorney, explaining that teams cannot accept parts of the 2025 Charter Agreement while suing over parts they disagree with.

The impact of this decision will be significant — six cars from both teams must qualify based on time at Dover Motor Speedway. The affected cars include:

  • No. 23 (Bubba Wallace)
  • No. 35 (Riley Herbst)
  • No. 45 (Tyler Reddick)
  • No. 4 (Noah Gragson)
  • No. 34 (Todd Gilliland)
  • No. 38 (Zane Smith)

The fate of their six charters remains unclear, including two purchased from Stewart-Haas Racing last year. While the main lawsuit is set for December, the teams are likely to lose their charters within the next seven days.
