23XI Racing and Front Row Motorsports Face NASCAR Charter Rights Loss

Based on the U.S. Court of Appeals decision in early June 2025 — two prominent NASCAR teams face imminent loss of their charter rights.

23XI Racing and Front Row Motorsports suffered a major setback following the revocation of preliminary injunction that allowed them to compete as chartered teams during ongoing antitrust litigation.

“Today, we filed a petition with the U.S. Court of Appeals for the Fourth Circuit requesting a rehearing before the full court,” stated Jeffrey Kessler, lead attorney for both teams.

The court previously questioned Kessler’s arguments about the injunction’s basis — stating that his antitrust theory “is not supported by any case of which we are aware.”

NASCAR has filed a countersuit against both teams, while the main trial is scheduled for December 2025 — adding complexity to this ongoing legal battle.
